AN ACT
MAKING AN APPROPRIATION TO PRODUCE AND DISTRIBUTE STATEWIDE A
BOOKLET PROVIDING INFORMATION TO HELP PREVENT DIVORCE.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. APPROPRIATION.--One hundred thousand dollars
($100,000) is appropriated from the general fund to the board of
regents of New Mexico state university
for the cooperative extension service for expenditure in fiscal
year 2002 to produce and distribute a booklet entitled Before You
Check Out-Check Your Options that
would offer couples in conflict a range of options available to
them prior to marriage dissolution. The available options shall
include statewide private, public and
faith-based programs and counseling services. Additionally, the
booklet shall offer guidance regarding communication skills,
conflict resolution, financial counseling,
substance abuse issues, ending an affair, rebuilding or
recommitting to a marriage, domestic violence resources and other
topics that could benefit people whose
marriages are in crisis. Any unexpended or unencumbered balance
remaining at the end of fiscal year 2002 shall revert to the
general fund.

AN ACT
MAKING AN APPROPRIATION TO CONTRACT FOR DEVELOPMENT OF A HIGH
SCHOOL CURRICULUM TEACHING THE VALUE AND BENEFIT OF MARRIAGE,
CONFLICT RESOLUTION AND OTHER SOCIAL SKILLS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. APPROPRIATION.--Twenty thousand dollars ($20,000) is
appropriated from the general fund to the board of regents of New
Mexico state university for
the cooperative extension service for expenditure in fiscal year
2002 to contract for development of a curriculum to be used in all
eighty-nine school districts in the
state that will teach the benefits and value of marriage, the
skills involved in conflict resolution and communication, the
social, financial and health implications of
divorce and the impact of divorce on children. Any unexpended or
unencumbered balance remaining at the end of fiscal year 2002 shall
revert to the general fund.

AN ACT
RELATING TO TAXATION; ENACTING AN INCOME TAX CREDIT FOR
COMPLETION OF PREMARITAL EDUCATION OR MARRIAGE MAINTENANCE
PROGRAMS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. A new section of the Income Tax Act is enacted to
read:
"[NEW MATERIAL] CREDIT--PREMARITAL EDUCATION OR MARRIAGE
MAINTENANCE PROGRAMS.--
A. A resident who files an individual New Mexico income tax
return and who is not a dependent of another individual may claim a
credit in the amount of one hundred
dollars ($100) for completion of a premarital education or marriage
maintenance program in the taxable year for which the credit is
claimed.
B. The credit provided in this section may only be deducted from
the taxpayer's New Mexico income tax liability for the taxable
year.
C. A husband and wife who file separate returns for a taxable
year in which they could have filed a joint return may each claim
only one-half of the credit provided under
this section that would have been allowed on a joint return.
D. The credit provided in this section may be claimed only for a
premarital education or marriage maintenance program:
(1) that provides a minimum of six hours of education or
counseling in no less than three separate sessions;
(2) is conducted by an official representative of a religious
institution or his designee or a person who is licensed or
certified pursuant to state law as a marriage and family
therapist, a psychiatrist, a psychologist, a professional clinical
mental health counselor, an independent social worker or a
certified family life educator; and
(3) for which the taxpayer has received written certification
verifying completion in a form determined by the department."
Section 2. APPLICABILITY.--The provisions of this act apply to
taxable years beginning on or after January 1, 2001.

AN ACT
MAKING APPROPRIATIONS FROM THE TEMPORARY ASSISTANCE FOR NEEDY
FAMILIES BLOCK GRANT FOR PROGRAMS TO ENCOURAGE AND SUPPORT
MARRIAGE.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. APPROPRIATIONS.--
A. The following amounts are appropriated from the temporary
assistance for needy families block grant to the board of regents
of New Mexico state university for the
cooperative extension service for expenditure in fiscal year 2002
for the following purposes:
(1) eight hundred thousand dollars ($800,000) to develop and
implement a statewide program to teach marriage skills and marriage
maintenance skills, including the
meaning and benefit of marriage, communication skills, conflict
resolution skills, the economic and social impacts of divorce and
the effects of divorce on children, to
participants in the temporary assistance for needy families
program; and
(2) two hundred fifty thousand dollars ($250,000) to develop and
implement a statewide media campaign to laud the benefits of
marriage.
B. Any unexpended or unencumbered balance remaining at the end
of fiscal year 2002 shall revert to the human services department
and shall retain its character as
temporary assistance for needy families block grant funding.
